All Probate Matters

Whether a loved one has died testate (with a Last Will and Testament) or intestate (without a Last Will and Testament), his or her estate will need to be probated in the Probate Court if there are any assets in his or her name. If a loved one died owning any interest in real estate, the probate process is extremely important as a new Deed to the property will have to be recorded in the county where the property is situated to transfer ownership of said property. This includes both traditional real estate holdings and special titles like time-shares.

It is very important to begin the probate process as soon as possible after the death of a loved one, as dealing with creditors/debtors needs to begin right away. There are detailed forms that will need to be filed with the Court disclosing information regarding the decedent’s assets. An inventory of the decedent’s assets will need to be filed with the court disclosing any and all assets in which the decedent had an interest. After the 8-month creditor claim period expires, a Final Accounting of all money received into and spent out of the estate will need to be filed. Final distribution of the property will need to be made and all real estate will need to be transferred.
